Interesting, Seven "bombs" sent and not a single one detonated, not even by accident and now the FBI indicates that is a huge red flag. Either the bomb maker is a moron (likely) of the bombs are just duds (even more likely).

I saw this summary...

Four reasons why the package bombs are false flags:

  • Cui bono?: With the midterm elections days away, and with signs of the much-trumpeted “blue wave” rapidly receding, only Democrats — not Republicans or President Trump — could benefit from these package bombs. Why would any Trump supporter be so stupid as to send them?
  • Tom Sauer, President of MacArthur Group, Navy veteran and former bomb disposal officer, tweets: “Proper pipe bombs don’t have wires connected to both ends. That’s dumb.”
  • Gateway Pundit reports: “Several bombs sent out today have zero detonations”.
  • The packages do not have the U.S. Postal Service’s postmarks, stamp cancellation lines, and barcodes, as pointed out by blogger Boris Badenov of 12160 Social Network.

I did check #2 with a friend of mine who was in military intelligence (retired now) and whose job was to find and destroy tunnels under the DMZ in Korea and very familiar with explosives and he confirmed that Tom Sauer makes a valid point. I don't know much about explosive devices so I have no opinion on it.

Regardless of who made and sent the devices, it was pretty stupid move that does not help either side.

Either the programs is squeaky clean or it has plausible deniability with many, many, many layers of separation/insulation from the actual money men that make it impossible to trace back to the program.

I guess at my age I have seen enough of this type of thing in all aspects of society and I have become somewhat of a cynic.

Nope, white collar criminals don't really get long sentences unless it involves hundreds of millions of $ and lots of victims.

18-24 months out after 8-12 months for good behavior...why even bother trying to get a better deal? It is as good as it gets.

I believe that Gassnola said that Adidas did not give Fenny $20K to repay the $60K he allegedly received from a Maryland Booster and for which there is zero evidence. As far as I can tell there is no hard evidence that Fenni got the $60K in the first place: he has vigorously denied it all along btu then...so did Preston's mom. :smile:

Correction. Silvio did not receive $60K, his guardian did and considering that Silvio wanted to go and ended up at KU would appear to indicate he was not aware of the $60K payment Also, I don't believe there is any proof that Fenni even received the $60k, it is all allegations at this time and Fenni could have been subpoenaed to testify but was not: maybe the FBI is saving him for the Under Armour trial?

I will guess all the pertinent information was presented and the one not admitted was deemed by the judge not to be relevant to the case at hand; whether this means is not relevant to other cases is yet to be determined.

More importantly, can individuals and/or programs be victims and co-conspirators at the same time? I will guess that a smart lawyer would have field day with the prosecutors trying to portray KU personnel or program as co-conspirators when the trial that just ended found then to be victims...but then, I have read of stranger things happening in courtrooms.

I was at a client's yesterday and on his desk he had a bobble head of who he said was Kevin Kietzman but to me it looked just like that of Jarred, the former Subway spokesman. I would avoid both like the plague.

Realistically and given the small amounts of $ involved (in the big scheme of things), what are the chances that the sentences are longer than a few months? Would it be worth it to the defendants to deal for shorter sentences which might amount to a few months when the option of keeping their mouths shut might result in some corporate loyalty reward down the road that might even include getting their jobs back?

Would the judge not allowing defense evidence result in grounds for a reversal on appeal? If yes, it could take years to sort it out.

As far as I know deals are gone as far as guilt or innocence; however, a deal could still be made about sentencing recommendation in exchange for cooperation and/or additional information that will help with future cases.

As I understand...and I could be wrong...this type of cases receive relatively minor sentences ↗, maybe months in a so called "country club" type detention facility where white collar criminals go. Given the relatively small $ involved I would think sentences will be months rather than years.

Hopefully the lawyers can chime in with pertinent information

Not the same situation at all. I seem to recall the NCAA had warned Memphis of serious issues with Rose and they chose to play him any way. I believe there was enough contemporaneous evidence that Memphis was aware of the issue long before it admitted and became public.

The FBI started with its best and strongest case hoping that a conviction would lead to additional charges being brought against a number of other program and new testimony extracted under oath from people involved would be available for the next round. The only testimony we heard was that KU did not know about the payments and whether this is true or not, it is the only available evidence and it favors KU.

If the FBI gets a conviction, then KU has been shown as a victim and somewhat immunized. If the FBI does not get a conviction then further prosecution is doubtful.

At least on paper KU has shown that when it became aware of irregularities (Preston, Alexander) it proactively chose not to play them until the situation was cleared and it is a huge plus for KU. Contrast this withe Arizona that chose to play Ayton even after allegations (confirmed at the trial) that Ayton received money and yet I have not heard a peep about any penalties.

Yes, Cliff was not officially suspended by the NCCA; KU chose to not play him as a precaution and to take away the NCAA leverage. The NCAA cannot punish a school for acting proactively once it finds out of potential issues.

The NCAA penalty will be telling. Any thing more than a few game suspension and KU might have more problems we don't know. If, as I anticipate, it comes down to a few game suspension then it is smooth sailing moving forward,

If I underrated correctly, Adidas did not pay anyone. It made payments to its affiliate AAU teams (independent contractors) which in turn distributed the money. If there was a 1099 form to be issued it should have come from the AAU teams and not Adidas;. I will guess Adidas payment to its affiliate AAU teams are properly recorded. If Adidas correctly recorded payment to its AAU affiliate teams then I don't see how it broke the law.

As far as secrecy, it does not necessarily imply acknowledgement of wrong doing; Adidas can simply say it was confidential information that was kept under warps to not tip the competitors that are doing the exact same thing and going after the same players.

If I understand correctly, the admitted evidence and testimony under oath at the trial indicated that KU was not aware of any of the payments and it followed the NCAA ruling that Silvio was eligible and cleared to play.

This reminds me of a time I was in California driving on the Antelope Valley freeway off the 405 and headed to the Palmdale/Lancaster area. The speed limit was 55MPH and traffic was moderate and moving at a steady 70 MPH; I was driving at a conservative 60 MPH on the right lane. I noticed on my side mirror a CHP motorcycle with flashing light coming fast in between the two lanes (motorcycles are allowed to do this in California) and I looked at my speedometer and saw I was driving slightly over the speed limit but considerably slower than the rest of the traffic so I did not think much of it. The CHP office pulled next to me and motioned to lower my window and when I did he told me using the motorcycle speaker...speed it up buddy, you are holding up traffic. I pointed to the speedometer and he repeated the warning to speed it up which i promptly complied. I always wondered whatt he outcome would be if a few miles down the road I was stopped and given a ticket for speeding...would it hold in court?

This seems to be a similar case where KU was given the go ahead by the NCAA to play Silvio and KU followed the decision and rules carefully. Can the NCAA rule against KU after having cleared Silvio and given KU the go ahead to play Silvio, particularly when there is no evidence that KU knew of the alleged violation? I would think that any penalty the NCAA levies would be on Silvio and not on KU. Thoughts?

I imagine that the result of the FBI trial will in part help speed up the process. As far as I can tell the only thing that was "somewhat" proven in court is that Silvio's guardian received $2,500 for on-line classes but he did not testify and has maintained all along (for what its is worth) the he did not receive any money. If this is all that can be proven the I imagine restitution and 2-3 game suspension would be the outcome. Now, if the NCAA has solid evidence of additional payouts and that Silvio was aware then it could go a different way.

Are we in a Billy Preston wait - Part Deux? Will the decision come any time now? :smile:

The Sprint Center is a great basketball venue and the Power and Light District provides a nice environment for the tournament. With KU always doing well and ISU and KSU fans always eager to travel to KC, the Tournament will always have a decent audience.

I would guess there are two ways to look at it. While a guilty verdict might insulate somewhat the alleged aggrieved parties, it would also give the FBI impetus to follow up with other cases it has waiting and we would have a never ending process.

I would think the first case the FBI brought up was the one with the bests chance of success and a not guilty verdict would for all practical purpose send a message to the FBI...

...you overreached in this case, let the IRS handle the money changing angle and you cannot be the enforcer of NCAA rules; let it enforce it own rules and if financial redress is needed it can go to civil not criminal court for reparations.

I am not sure which one is the better outcome. I would lean towards the second insofar as it would likely end the investigation, the NCAA can generate a general, one time amnesty and things can go back to "normal."

I am not too worried about Travis. Yes, he went off for 29 point against KU in Lawrence in 2016 but 19 of those point came from the FT line. Doke 4 fouls in 11 minutes, Coleby 5 fouls in 7 minutes, Lucas 4 fouls in 18 minutes, refs were calling everything on KU and Travis took full advantage. Next season in 2017 he was held to 12 point and 4 rebounds in 39 minutes while Doke had 24 point and 7 rebounds in 26 minutes.

I believe the big scorer for UK will be Herro.

Exactly. The $2,500 is the only money related to KU and even for that, there is no evidence KU knew about it. If I recall correctly, Darnell Jackson was found to have received a pick up truck worth $5,000 and he got a 9 game suspension. Josh Shelby was found to have received ~$5,800 and was suspended for 9 games. Malik Pope was suspended 1 game for allegedly taking a loan for $1,400. Worst case Silvio is asked to reimburse the money and get a 2-3 game suspension.

Exactly. MU should be his dream job, he is from St. Louis and he had the Porter family with two outstanding players and originally from Columbia to give him a leg up and now it seems that Jontay, who would have been first round pick last draft, will not play again for MU.

MU was projected #8 in the SEC before the injury and now it will drop at least a couple of spots and will not better moving forward with lots of conference teams on the upswing.

Considering the players he had he did not do as well as expected in his third year at Tennessee and so he bolted. The 3 year pattern seems pretty established. Without Jontay MU is back to the middle of the bottom half of the SEC which will be stronger this year

Gonzaga is the team a lot of people are not taking seriously but they will be very good with NBA caliber experienced players and a deeper bench that Duke. Duke is overrated at this time and there are now rumors about Zion eligibility which if true would seriously handicap Duke.
