Manhattan Jaspers, Who? β€’ Nov 11, 2023 01:30 AM

Wikipedia: The Jaspers nickname comes from Brother Jasper of Mary, F.S.C., who was a memorable figure at the college. He was head of resident students, athletic director, and baseball coach during the late 1800s. (He is also credited with inventing the 7th inning stretch after noticing the players were regularly getting worn down at that point.)

As to basketball, the Jaspers' most notable victory was upsetting Jerry West's WVU in the 1958 NCAA 1st rd. They have made the tourney 8 times, including 2014 and 15.

@AsadZ Pacheco, Humphrey, Smith, Rice,
to name a few ...not so bad in my estimation. (Yes, Rice has some drops. Mahomes has some fumbles and interceptions. Why expect a rookie to be error-free?)

NCAA In Danger β€’ Nov 04, 2023 07:10 PM

@FarmerJayhawk

Didn’t your mom warn you to stay away from lawyers? I certainly do!

Your friend is right, so long as class certification is likely to survive an interlocutory (meaning while case is going on, i.e., no judgment yet; can be with or without a stay) appeal. Defendants facing hundreds or thousands of cases fear judgments against them that could force bankruptcy; plaintiffs fear not being abl to collect anything for the same reason. Settlement gives relative certainty.

I did have a case involving a class action settlement up in Boston before I became a judge. I was my agency's representative in US District Court in Boston after we got a call late one afternoon from the judge's clerk asking us to come the next day. A settlement being considered involved a class action where the plaintiff investors in federal court were agreeing to the defendant's demand that any settlement depended on shutting down all cases filed by other people against the same company in our agency's reparations program (an administrative forum which was an alternative to court or arbitration). The judge wanted to know what we thought.

We were mad as hell. I flew up 5 times in the next 4 months trying to deal with dozens of lawyers all conspiring to solve their clients' problem by screwing hundreds of people not even in their case. And trying to convince the judge that his power to approve a settlement between his parties did not entitle him to enjoin an agency from hearing legal cases committed to us by Congress rather than to the federal courts. Separation of powers, Constitution...little things like that. The judge was chafing at the bit, but finally backed down when I told him I was authorized to go up the street to the Court of Appeals to get a writ voiding any decree he issued. They finally settled without all that crap.

Long story and the stress was why I quit litigation to become a judge...but I got to see Boston. Even took my luggage to Fenway and bought an extra seat for it one night. Imagine doing that post 9/11?

NCAA In Danger β€’ Nov 04, 2023 02:59 PM

@BShark I know nothing about this stuff, but I judged commodity investors' cases for years and never took an investment class in law school, so obviously ignorance is no bar to opining! I did work on a class action case once...before I passed the bar.

I will have to get back to you on this one....

Both will involve my dream...no commercials or halftime blather!

Hesela sounds ready to launch rockets β€’ Oct 27, 2023 01:06 PM

Millions of people I referred to are the ones guilty of supporting extermination of supporting Israel and Jews. That statement doesn't say they all deserve death, but in calling for death to all Jews they sure are not innocent.

If you think Hamas had successfully hidden from the two million Gazans affected by the attempt to root them out, do you think those Gazans were forced to march on October 7 and carry signs calling for death to all Jews? I have yet to see millions of Jews marching calling for the extermination of Muslims, Arabs, or Palestinians.

I think many of us who grew up during the 1967 and 1973 wars waged to drive Jews into the sea, and who watched the Munich Olympics massacre, are more sensitive to how determined their enemies are. Maybe knowing Holocaust survivors, and being an historian of WWII, has also given me a perspective you are unlikely to share.

But until you are willing to recognize that whole history that underlies Israel's refusal to accept nonstop threats and attacks, and unless you can come up with an actual proposal other than calling Israel's retaliation "genocide", there probably isn't much hope that you will recognize who the bad guys are in this mess.

Hesela sounds ready to launch rockets β€’ Oct 27, 2023 10:10 AM

@benshawks08 A possible solution would be for Palestinians to refuse to harbor or support the terorist elements. When literally millions of Palestinians in Gaza and West Bank, and their supporters world-wide, celebrated the Oct 7 attacks on "innocent lives" and the attackers as martyrs in the never-ending effort to kill Jews, they forfeited their right to claim innocence.

When Palestinians disavow that goal and stop hero-worshipping terrorists, I will see more equivalency in the conflict.

Hesela sounds ready to launch rockets β€’ Oct 27, 2023 01:43 AM

@benshawks08 Let me edit that last post because I didn't mean to reduce your statement to discounting the number of Oct 7 victims. What I meant is I object to counting the number of deaths on both sides and deciding that the higher number allegedly killed in the response makes it worse than the initial terrorism.

Hesela sounds ready to launch rockets β€’ Oct 26, 2023 11:26 PM

@benshawks08 And your answer lets the terrorists get away with it until someone smart figures it out. But you thinking the problem is just a few dead people on Oct 7 [Edit: I realize this is an oversimplification of what you said; see next comment] ignores the motivation of the side you want to protect...extermination. The Israeli motivation is to survive.

Hesela sounds ready to launch rockets β€’ Oct 26, 2023 06:01 PM

@benshawks08 Israel is at war with a group pledged to the extinction of Jews, a group hiding in a population that harbors it and that refuses to accept Israel's right to even exist, a group that butchered hundreds of Israelis while laughing and sending proud videos back home.

Exactly how is Israel supposed to wage such a war?

Frankly, I haven't been too impressed by JD's decision making. Last year's streak came to a shrieking halt as he was wrestling against several guys to get 1 more meaningless yard instead of accepting going OB. QBs and RBs need to understand it is not brilliant to be fighting 3 guys for extra inches when the first down is several yards away...or already gained.

@approxinfinity Of course the Chiefs are villains! Tom Brady was a villain, Lebron is a villain, Wilt was a villain, the Yankees were villains... Yes, all highly successful teams and players get hated. As to the Chiefs, if you read the comments on any national sports media for the past 5 years, you will know that ALL calls go the Chiefs' way, that Roger has issued a mandate to make sure Mahomes (the "chosen one") always succeeds, and that the Fix is in so there is no reason to even watch the games. (And any ratings figures about the Chiefs are fake, btw.) Then there are Tyreek, Hunt, Clark, all those felons...

Golly, where ya been?

Chiefs season long game thread β€’ Oct 21, 2023 11:22 AM

@benshawks08 Maybe you would be more responsive to a request to keep highly charged social controversies out of this part of the sports board. IARP update β€’ Oct 12, 2023 01:27 AM

@DanR Sorry! Thx for the correction. Obviously my memory truncated it! I still think figuring it out meant figuring out how to get Zion not necessarily providing the goodies. I guess I find it hard to believe that with so much money flowing from Adidas T couldn't have easily gotten it if that was our desire.

IARP update β€’ Oct 12, 2023 01:07 AM

@DanR said in IARP update:

@wissox I think $100K in cold hard corrupt cash was the amount Coach T agreed we needed to get to meet Duke's offer in addition to the house and a year's worth of nauseating ESPN hype of Zion (which, ultimately, KU could not guarantee).

The rewording you did of the discussion added "Coach T agreed we needed to get to meet Duke's offer". All T really said was that the word was the family wanted that much. There was nothing said about KU providing it. Self told him to see what he could do, but that was to recruit Zion. If it was permission to offer the money, why isn't there a slew of money discussion like all the other schools had?

IARP update β€’ Oct 11, 2023 09:30 PM

@dylans So you think Self cheated? Nothing in the IARP findings establishes that.

Legally, this was a case where an outside consultant paid athletes to go to KU. His actions as a representative of Adidas were held to be the responsibilty of KU because of the bogus booster theory since Adidas helped KU recruit. Vicarious responsibility for wrongdoing is a status matter, not a knowledge matter. They specifically found no evidence that KU and Self failed to supervise adequately. Had there been any evidence of knowledge or involvement by KU and Self in Adidas's cheating, the Level 1 charges would have stood.

So how do you conclude Bill is a cheater?
